General Terms of Sale

These General Terms of Sale (hereinafter, General Terms) pertain to the remote purchase of products, via the Internet, from the website (hereinafter, Site).
The owner of the site is Paris Elysées Perfumes LLC

Acceptance of the General Terms of Sale

All purchases of products carried out through the Site (hereinafter, Purchase Agreements) by users who access the site (hereinafter, Clients) are governed by these General Terms and the Consumer Code.
Upon execution of the Purchase Agreement, pursuant to the procedure, Client agrees and undertakes to comply with these General Terms.
Client is therefore requested to carefully read these General Terms prior to making any purchase transactions and, once the purchase procedure provided by the Site is completed, to print or save them, as desired.
PEP may amend the contents of these General Terms at any time and without prior notice. The General Terms published on the Site at the time an order is sent by Client will apply to Purchase Agreements.

Products is a website that sells perfumes and natural cosmetics under the brands Paris-Elysees, Iris Diffuser and Essential Elements (hereinafter, Products).
All the Products offered are illustrated in detail on the Site’s home page, within their respective sections. which are classified by Product category.
The visual display of Products on the Site, where available, is usually in the form of a photo image of the Products themselves and its sole purpose is to present them for sale, without any guarantee or commitment by PEP regarding the exact match of the image depicted on the Site with the actual Product; this specifically refers to the actual dimensions and/or colours of the Products and/or the packaging.
In the event of a difference between the image and the written product specifications, the latter will prevail.

Purchasing procedure

Client may purchase the Products in PEP’s e-Catalog, which are illustrated in detail on the homepage in the corresponding product category sections, as described in the relative product specifications contained on the Site, complying with the technical access procedures explained thereon.
The publication of Products on the Site constitutes an invitation to Client to fill out a purchase offer. An order sent by Client is deemed to be a purchase offer and implies complete awareness and acceptance of these General Terms.
The proper receipt of the Client’s purchase offer is confirmed by PEP through an automatic response sent to the e-mail address provided by the Client, which confirms only the proper receipt of the offer by its computer systems. This confirmation message will indicate an “Order Number,” to be used in all subsequent communications with PEP. The message will reiterate, in addition to the information required by law, all the data entered by the Client, who must verify the accuracy thereof and immediately give notice of any corrections. Any extra expenses incurred due to incorrect information which was not promptly reported will be Client’s exclusive responsibility.
Clients may view each order on the Site in their account immediately after the order has been sent, and it can be canceled until it is sent to the warehouse for processing.
Occasionally, some Products offered may not be available and, in that case, if the products selected by the Client are not available, either totally or partially, the order will be sent with the available products after having notified the Client about the unavailable products.
Payments by credit card or PayPal require only an authorization (see Payment Methods), or a reservation of the funds without being actually debited at the time the Client puts in the order. Client’s payment will actually be debited only when the products are delivered to the shipper designated for the shipment. During this phase, PEP will moreover issue the invoice corresponding to the order.
This implies that if the Client cancels the order (through the private area or through a request to Customer Service), no amount will be debited and therefore PEP will not have to provide any refunds.
Each Purchase Agreement stipulated between PEP and Client shall be understood to be made with the acceptance of the order on the part of PEP.
PEP shall be free to accept or not accept, at its own discretion, the order sent by Client, without Client being able to lay claims or rights of any sort, in any capacity, even compensatory, in the event of non-acceptance of the order.
In particular, PEP reserves the right not to accept purchase offers and cancel orders that do not give adequate assurance of solvency or if – even after checking with the network that manages credit card payments – anomalies are found in the transactions and in the payment methods used by Client.
Confirmation of the order is given to Client at the time in which the Products are delivered to the shipper designated for the shipment with the corresponding issuance of the invoice.

Product Pricing

All Product prices are clearly indicated on the Site and include VAT. Shipping expenses are adequately displayed at the time of the order. The cost for each shipment may vary, depending on the shipping and payment methods as well as the final destination and total amount of the order.

Shipping Methods and Expenses

PEP ships to all countries indicated on the Site, and delivery is made without an appointment.
PEP issues an invoice for the Products purchased when they are delivered to the shipper for shipment, which is e-mailed to Client. The information provided by Client will be used to issue the invoice. No changes to information are allowed once the invoice has been issued.
PEP will not be liable in any way to Client for any delays in filling the order or in delivering the Products listed in the Purchase Agreement.
The Products ordered will be sent to the mailing address specified by Client. When PEP has delivered the products to the shipper, the user will receive an e-mail confirming shipment.
Deliveries are made from Monday to Friday, during normal business hours, except on national holidays. The delivery is deemed to have been completed when Products are made available to Client at the address specified on the order form.

When the Products are delivered by the shipper hired by PEP, Client must carefully check:
a) That the tamper-proof label is intact and the packaging has not been damaged or otherwise altered.
b) That the number of units delivered matches the amount noted in the shipping document.
Client must immediately report any damage to the tamper-proof label, the packaging and the Products or if the number of units/packages or indications do not match, by contacting PEP’s Customer Service, indicating the order in which these problems occurred.
Cases of force majeure, unavailability of means of transportation, and unforeseen or unavoidable events that result in a delay in deliveries or make deliveries difficult or impossible or cause significant increases in PEP’s delivery expenses, will give the the latter the right to break up, resend or cancel the order, wholly or in part, or to terminate the Purchase Agreement. In these cases, PEP must immediately inform Client of its decisions by the e-mail provided by Client and the latter will only be entitled to a refund of any monies already paid, and will exclude any other claims against PEP, for any reason.

Payment Methods

The payment for the Products purchased may be made by credit card through our provider  or PayPal under the terms specified below:

– Online by Credit card

The following credit and debit cards are accepted: Visa, Mastercard, American Express card, Dinner’s Club
All information is transferred encrypted through an SSL certificate and therefore cannot be intercepted by outside parties.
Furthermore, the data is entered directly on OGONE website, thereby guaranteeing maximum security.
The amount of the order is not debited from the card immediately, but during a subsequent phase, within the limits authorized by Client.
When the order is entered on the PEP Site, an authorization will be requested only for payment of the amount indicated (very often, the bank which issued the card sends an SMS/e-mail to the Client at this time).
The authorization does not imply that the money has been debited, but simply that the corresponding amount has been set aside.
The amount due will actually be debited upon delivery of the order to the shipper, delivery company or any other entity to which PEP assigned the delivery.
This guarantees that the credit card is debited only upon actual shipment of the Products and only for the amount corresponding to the Products that were actually shipped.

– PayPal

PayPal, an eBay group company, is a quick and secure payment system.
Once payment through PayPal is completed, the purchaser will be redirected to the PayPal website where they can access their account by entering a personal e-mail address and password.
After registration, payments can be made through PayPal without having to re-enter the information for subsequent purchases.
By choosing to pay through PayPal, the amount is debited directly from the designated credit card (Visa, Visa Electron, MasterCard) or prepaid card (PostePay). PayPal safeguards the purchaser’s information so that no financial information is divulged.
PayPal will send a confirmation e-mail for each transaction performed using this method.
Please note that the amount of the order is debited from your PayPal account when the order is delivered to the shipper. When the order is entered on the Site, an authorization request will be made simply to verify available funds in the Client’s PayPal account, without any debit being made.
In the event of a cancellation, the amount will be refunded to Client’s PayPal account.

Right of Withdrawal

The consumer Client (that is, an individual who purchases the merchandise for purposes that are not related to their professional activity, i.e., without indicating a VAT Registration number) has the right to withdraw from the purchase agreement for any reason and without providing any explanation, under the terms stated below.
In order to exercise this right, Client must send a communication within calendar 14 days from the date of receipt of the merchandise by contacting customer service.
PEP staff will contact you with instructions on how to return the product.
The withdrawal can also apply with limitations to individual Products which are listed in a single Purchase Agreement.
An essential condition to exercising the right of withdrawal is that the returned item must be basically intact. In any case, it is sufficient that the product be returned in a normal state of preservation. Once the integrity of the returned Product has been verified, PED will refund the entire amount paid for the Products included in the Purchase Agreement subject to withdrawal, within 45 days from receipt of said Products.
PEP will refund the entire amount of the order or a part thereof if the withdrawal is partial, via bank transfer or any other method specifically agreed upon between PEP and Client.
Please note that, pursuant to existing laws on the subject, PEP will refund Client the amounts paid by the latter for the Products. PED shall not refund any shipping costs incurred by the Client.
Client will be responsible for the expenses required to return the withdrawn Products to PEP.

Product Non-compliance and Defective Products

Products offered on the Site comply with US legislation currently in force in USA. The images and colours of the Products published on the Site may differ from their actual images and colours due to local systems’ display settings and/or devices used to display them.
In the event that the products purchased do not match the description published on the Site and in the event that a Product is broken or defective, Client is entitled to an immediate refund for the defective item, once photographs showing the damaged or defective Product have been submitted by contacting cusomer service.
A communication from PEP staff will follow, indicating the refund method. The refund may also be in the form of coupons for discounts on future purchases whose value is higher than the amount to be reimbursed, and then PEP will not have any additional liability of any kind.

Handling of Personal Data

PEP handles Client information in accordance with provisions in existing laws on the subject of personal data protection, as specified in the notice in the specific section titled “Privacy Notice”.

Communications and Claims

All communications or claims from Clients to PEP relative to Purchase Agreements must be sent by e-mail to customer service.

Intellectual Property Rights

All trademarks (registered or not) as well as any intellectual property, distinguishing marks or name, image, photograph, written text or graphics and more generally, any other intangible assets protected by international laws and conventions on intellectual property and industrial property rights reproduced on the Site will remain the exclusive property of PEP and/or its assignors, and accessing the site and /or concluding Purchase Agreements does not afford Client any rights thereupon. Any use, even if only in part, thereof is prohibited without PEP’s prior written authorization, which exclusively reserves all relative rights.

Applicable Jurisdiction

Any disputes will be resolved by the competent judicial authority based on applicable laws.
